Appeal to 8th Circuit Filed in Right-to-Lie Case! PDF Print E-mail

 

On March 5, 2010, the Plaintiffs in the 281 Care Committee case have filed their appeal to the U.S. Court of Appeals for the Eighth Circuit in the right-to-lie case.  The United States District Court dismissed their claims that Minnesota's bans on false, non-defamatory political speech is unconstitutional.

Plaintiffs' attorney Erick Kaardal responds, "The United States District Court did not address the substance of my clients' claims -- dismissing the matter on technical grounds.  The fact is the State of Minnesota is prohibited under the First Amendment from regulating non-defamatory political speech.  Whether political speech is false or not, as long as it isn't hurting anyone's reputation, is none of the government's business.  We like our chances in the U.S. Court of Appeals."
